Indian courts are overcrowded. It can take ages to resolve a simple dispute. Then where should parties with serious legal disputes involving stakes of crores or rupees (often thousands of crores) go?\
Mediation is a useful approach when parties in dispute have an ongoing relationship that they wish to preserve, such as a joint venture. This is possible whereas there is unlikely to be any legal basis for seeking such relief in arbitration or litigation.
All payment shall be made either through Demand Draft/Payment Order drawn in the name of “Delhi Arbitration Centre” payable at New Delhi or through any online payment gateway.
Like mediation, conciliation is a voluntary, flexible, confidential, and interest based process. The parties seek to reach an amicable dispute settlement with the assistance of the conciliator, who acts as a neutral third party.
DAC invites Retired Judges, Advocates, Technical experts such as Engineers, Chartered Accountants, Bureaucrats, having considerable experience in arbitration to be empanelled in the DAC Panel of Arbitrators.
For administered mediation or arbitration by DAC, there should be an appropriate ADR clause in the contract or in the absence of any such clause; there should be an agreement between the parties to arbitrate under the DAC Rules.
